User Agreement
Please read this Agreement carefully before using JetTrade.com.
Throughout this Agreement, the words "I", "me" and "my" and "we", "us" and "ours" refer to the customer who signed the JetTrade, Inc. New Account Application. "JetTrade" refers to JetTrade, Inc.. The term "website" refers to JetTrade.com.
1. This Agreement is a separate agreement from the new account agreement that I signed prior to the opening of my account at JetTrade. In the case of any conflict between the two agreements, I understand that the new account agreement takes precedence.
2. As a matter of policy, JetTrade does not solicit, and will only accept unsolicited customer orders. All activity in JetTrade customer accounts is self-directed. This means that I alone make decisions concerning my account(s), including the type of account to be set up (cash, margin and/or option) and the activity in it. Under no circumstances is the information contained in this website to be construed as an offer to sell or the solicitation of an offer to by a particular security.
3. Nothing here is an offer or solicitation of any security, product or service in any jurisdiction to any person to whom it is unlawful to make such an offer or solicitation, and JetTrade may not open an account for any such person. For example, JetTrade may not deal with people accessing this site from the United Kingdom unless such people fall within certain exempt categories provided under English law.
4. I understand and agree that while I may trade in my account as I see fit, JetTrade has hereby notified me that even at the extremely low fees they charge for each transaction, I may incur heavy losses as a result of transaction fees and/or fluctuations in the market value of securities.
5. I understand that JetTrade currently has and may have agreements with third parties for those third parties to provide JetTrade Customers with access to certain business and financial information through JetTrade's website. As a service to its customers, JetTrade provides, through its facilities, access to, among other information, research, analysis, news, recommendations and other information prepared by third parties. However, I acknowledge that JetTrade does not prepare or review, and may or may not agree, with any of this information, and any information furnished by JetTrade regarding any particular stock transaction or investment strategy is based upon information and belief which is considered to be reliable. It is not represented that the information is accurate or complete, and the information should not be relied upon as such. I acknowledge and agree that I am responsible for determining the nature, potential value and suitability of such information and services.
Further, I acknowledge and agree that I will not consider any information obtained through JetTrade as tax, legal, accounting, or investment advice, or rely on any information as such. I further acknowledge that JetTrade and its data providers do not provide advice concerning the suitability or value of any particular investment in any security, futures, options or regarding any investment strategy, nor does JetTrade endorse or recommend products or the securities of companies that manufacture products whose advertisements may be available through JetTrade's website.
Furthermore, I acknowledge that there may be delays, omissions, or inaccuracies in the information or the website. I agree that JetTrade and its data providers shall have no liability, contingent or otherwise, for the accuracy, timeliness, completeness or correct sequencing of the information, or for any decision made by me, the customer, in reliance upon the information or this website, or for the interruption or delay of any data, information, or any other aspect of the website. There is no warranty of merchantability, no warranty of fitness for a particular use, and no other warranty of any kind, express or implied, regarding the information or any aspect of this website, including but not limited to, information access or order execution.
6. In no event will JetTrade or its data providers be liable to me or anyone else for any incidental, consequential, special or indirect damages (including but not limited to lost profits, trading losses, or damages that result from inconvenience, delay or loss of the use of this website) arising out of or related to this website, even if JetTrade has been advised or is otherwise aware of the possibility thereof, except as limited by applicable law.
7. I understand that website is the property of JetTrade and the information provided through it is protected by copyright of JetTrade or its third party providers. I agree not to reproduce, retransmit, disseminate, sell, distribute, publish, broadcast, circulate or commercially exploit the information in any manner without the express written consent of a member of JetTrade's senior management; nor to use this information for any unlawful purpose. I agree to comply with reasonable requests by JetTrade concerning the protection of its rights.
8. I alone am responsible for the confidentiality of my access number(s), password(s), and account number(s). I will be responsible for all orders entered through and under my access number(s), password(s) and account number(s), and any orders so received by JetTrade will be deemed to have been received from me. All orders shall be deemed to be made at the time received by JetTrade and in the form received.
9. I agree to immediately notify JetTrade's Compliance Department by facsimile at (513) 232-0319 if I have reason to believe or become aware of any:
(a) loss, theft or unauthorized use of my access number(s), password(s), and/or account number(s);
(b) failure by me to receive an electronic message (through website) that an order initiated by me has been received through the website and/or executed;
(c) failure by me to receive accurate, written confirmation of the execution of an order within five (5) business days after execution; or
(d) receipt of confirmation or electronic message of an order which I did not place, or any similarly conflicting report or information.
